Development Contributions & Solar Projects

Ground Mounted Commercial Solar PV & Planning Authority Development Contributions:

Development Contributions are usually attached to all grant of planning permissions as a levy by a County Council’s towards the maintenance and provision of Critical Infrastructure and Amenity within the County.

In the absence of a specific solar category in most Section 48 Development Contribution Schemes there is currently a lack of consistency throughout the Country on how contributions are applied to Solar Developments.

devguideFor example, some County Council’s apply a charge based on the Gross Floor Area of buildings i.e. substations and storage buildings only with other Council’s applying the Wind Turbine / MW  Rate of between €8,000 – €10,000 per MW.

FT are currently appealing a number of these charges directly to An Bord Pleanála on procedural grounds under the special provisions of Section 48 of the Planning & Development Act.

It is important to note that County Councils are commencing reviews of the Development Contribution Scheme to include a Solar Category. This process is a Reserved function of Council and therefore open to public participation, affording developers the opportunity to have their say in applying a fair, equitable and standard charge for solar development.

FT has experience in making successful submissions to County Councils on Draft Development Contribution Schemes forming successful planning and economic arguments for the adoption of a fair and equitable rate for development classed.
